The attorney for a black man shot by Atlanta police last month says the officer had no reason to fear for his life and a video released today proves it.

Surveillance footage shows DeAundre Phillips sitting in the passenger seat of a car at the Atlanta Public Safety Annex.

Two plain-clothes officers approach him. They talk with Phillips and then there’s a struggle.

Phillips crawls into the driver’s seat to drive off, when one officer jumps through the passenger door.

Police said that officer was dragged as Phillips drove away. But the Phillips family attorney, Chris Stewart, disputed that allegation on Friday.

“What do you mean getting dragged? The door was shut,” Stewart said. “The officer was all the way in it. If you watch it, the officer is tackling and struggling with him in the vehicle.”

The officer, 11-year veteran Yasim Abdulahad, fired his gun moments later. At that point in the footage, the car is out of view.

The Fulton County District Attorney’s office released the video today. The Georgia Bureau of Investigation is looking into the shooting. Its investigation is ongoing.

Stewart said the Phillips family will pursue a civil lawsuit against the Atlanta Police Department, in addition to criminal charges for the officer.

The family joined Stewart at the press conference and reiterated his calls for justice.
