Fulton County Judge Dismisses Plant Vogtle Appeal

Georgia Power moved to dismiss a case, which brought it to question protocol when regulators voted to continue with the Plant Vogtle project. The judge agreed with the company.

A Fulton County judge has dismissed a case over a controversial nuclear power construction project in Georgia.

Critics of the Plant Vogtle nuclear expansion had appealed a decision by state regulators to allow the project to continue, despite cost and schedule overruns. The critics said the Georgia Public Service Commission didn’t follow protocol when it voted to keep the project in December 2017.

Georgia Power, which is the biggest utility involved in the nuclear project, moved to dismiss the case, and just before Christmas, that motion to dismiss was granted.

The judge agreed with the company that it wasn’t the right time to appeal the regulators’ decision.
