Georgia DOT Sued By Atlantan Over I-85 Construction Noise

An Atlanta man is suing the Georgia Department of Transportation for the noise coming from the crews repairing I-85.

The Georgia Department of Transportation is being sued for the noise its making as it repairs the collapsed I-85 bridge.

Atlanta resident Tyler Gaston lives near the construction site and said the non-stop repair work is too loud and is causing him sleep-related problems. The complaint was filed over the weekend in Fulton County Superior Court.

“Generally courts are going to side with the state in a situation like this,” “WABE legal analyst Page Pate. said. “I mean the work needs to be done, there is some expectation that people will be inconvenienced and the state is always different than a private contractor or, say, a private business.”

GDOT spokeswoman Natalie Dale said the department has no comment.
