The parents of a 2-year-old who was denied a kidney transplant by Emory Healthcare are now in negotiations with the hospital.

The hospital refused the surgery in early October after the child’s donor, his father, violated parole. It told the family it wouldn’t reconsider the request for 90 days.

But Friday the parents announced they have a meeting Monday with hospital officials to come up with a new timeline. Carmellia Burgess said her son, A.J., needs the transplant because he was born without working kidneys.

“When he got here, they said he wouldn’t live 24 hours. He’ll be three in January. So he’s a fighter,” she said.

The child was scheduled for a separate surgery Friday to treat an infection, which he developed after the canceled transplant.

In a statement, Emory acknowledged the meeting and the need to move forward on A.J.’s behalf.

Over the last month, the case has drawn national attention and brought protesters to Emory.
