Analysis: GSU law professor on class action lawsuit against birthright executive order

In June, the U.S. Supreme Court ruled in favor of the Trump administration by limiting the power of federal judges to issue nationwide rulings that block executive orders.

The center of that court case included President Donald Trump’s executive order seeking to restrict birthright citizenship. The court didn’t rule on the order itself but left open another possibility for opponents to challenge it: class action.

That’s exactly what followed when, last Thursday, a federal judge in New Hampshire blocked Trump’s order while certifying a class action lawsuit against it.
