A DeKalb County judge says demolition can continue at Intrenchment Creek Park with proper permits. This comes after environmentalists tried to stop work at the park while a lawsuit over the land continues.

The land is currently owned by Ryan Millsap of Blackhall Real Estate Phase II LLC, and is the center of a controversial deal Dekalb County made with the private company.

The County traded Intrenchment Creek Park for a nearby area in 2021. Environmental groups sued the county, saying in part it doesn’t have the authority to exchange public park land.

The South River Watershed Alliance filed a temporary restraining order against Blackhall, but it was denied by Judge Stacey Hydrick.

In the meantime, there is currently a stop work order from the DeKalb County Department of Planning and Sustainability saying Millsap needs permits to cut more trees down.
