In a decision that could affect future drunk driving prosecutions, the Georgia Supreme Court has unanimously struck down a major part of the state’s DUI law, saying it violates the Georgia constitution’s guarantee of a person’s right not to incriminate himself or herself.
The 91-page decision traced the history of the different versions of the state constitution, to explain how it came to its conclusion.
On “All Things Considered,” WABE’s Denis O’Hayer spoke with the station’s legal analyst, Atlanta criminal defense attorney Page Pate, who talked about how the court arrived at its decision–and what it could mean for the future.
