Judge Rules In Favor Of Allowing Vote To Form Eagle’s Landing

A referendum on forming Eagle’s Landing is scheduled for November.

A Henry County judge denied Stockbridge’s attempt to stop some citizens from voting on forming the new city of Eagle’s Landing.

A referendum on forming the proposed city is still scheduled for November. Judge Arch McGarity listened to both sides for about two hours before making his decision.

Eagle’s Landing would take land from the existing city of Stockbridge. Stockbridge sued Henry County asking a judge to delay the November vote.

Tim Tanner, an attorney representing Eagle’s Landing, said the judge’s ruling is a positive start.

“We believe we have a strong case,” Tanner said. “We believe these bills are constitutional but at the end of the day the voters will decide what they want to do.”

Stockbridge Mayor Anthony Ford said he’s disappointed by the ruling but remained upbeat.

“I’m optimistic,” Ford said. “100 percent confident. We’re going to win this for the citizens of Stockbridge. Wholeheartedly.”

Ford said they do plan to appeal to the Georgia Supreme Court.
